PEPTRAIT TERMS OF SERVICE

This Terms of Service Agreement (“Agreement”) governs the use of the digital platform Peptrait, a product owned and operated by Peptle Private Limited, having its registered office at Sri Sai Tower, No. 994, V 95, 1st Main, Koramangala, 1st Block, Bangalore, India, 560034 (hereinafter referred to as “Peptle”, “we”, “our”, or “us”). This Agreement outlines the terms and conditions upon which individuals, professionals, businesses, institutions, and other entities (“you”, “User”, or “Account Holder”) access and use the services, features, tools, and functionalities of the Peptrait platform (“Platform”, “Service”).
By registering, accessing, or using Peptrait in any manner, you affirm that you have read, understood, and agreed to be legally bound by this Agreement and all applicable policies referenced herein. If you do not agree to be bound by these Terms, you must immediately discontinue use of the Platform.
1. DEFINITIONS
1.1 Platform – The Peptrait digital platform operated by Peptle, which includes websites, apps, APIs, subdomains, canvases, identity dashboards, verification systems, tools and associated services.
1.2 User/You/Your/Account Holder – Any individual, business, organization, or institution that creates an account or uses or access Peptrait’s services.
1.3 Peptle" refers to Peptle Private Limited, the owner and operator of Peptrait.
1.4 Peptle Policies – The unified set of policies and legal instruments governing all services under Peptle Private Limited, accessible at https://policies.peptle.com.
1.5 Verification Services – Services that assess, validate, or assign trust, credibility, identity, or operational information to Users or content.
1.6 Content – Refers to any data, documentation, profile, submission, certification, comment, text, image, video, file, communication, or other material that is posted, submitted, uploaded, transmitted, or published by Users on or through the Platform.
1.7 Canvases – Digitally managed identity or verification pages associated with individuals, businesses, or entities.
1.8 Trust Markers – Visual or metadata badges indicating status, verification level, or integrity ratings.
1.9 Verification Score – A composite or calculated trust measure derived from Peptrait’s internal or partner validation models.
1.10 Applicable Law – All local, state, national, and international laws and regulations that govern the use of the Platform.
1.11 Affiliates" refers to subsidiaries, related parties, or sister platforms governed by Peptle’s master policy framework.
2. SCOPE OF SERVICE
2.1 Peptrait is a digital platform providing identity, credibility, and operational presence tools to individuals and entities. It offers services including but not limited to verification, profile creation, branding, data analytics, trust scoring, and certification.
2.2 The Platform is intended to support transparency, ethical operations, responsible disclosures, and digital visibility of professionals, organizations, and enterprises.
2.3 You may access free or premium features based on your registration type, service subscription, or eligibility as per Peptle’s discretion.
3. ACCEPTANCE OF TERMS
3.1 By accessing, registering with, or using any part of the Peptrait Platform, you explicitly acknowledge and agree to be legally bound by the following documents, each of which is hereby incorporated by reference into this Agreement:
a. This Terms of Service Agreement;
b. The Peptle Master Policy System, available at https://policies.peptle.com;
c. The Peptrait Privacy Policy and all associated data and cookie policies;
d. Any additional agreements, disclosures, or consents presented to you in connection with your use of specific features, services, or verification processes within the Platform.
3.2 Continued access or use of the Platform following any updates, modifications, or amendments to the above-mentioned documents shall constitute your binding and irrevocable acceptance of the revised terms, whether or not you have reviewed them in full.
3.3 By using the Platform, you affirm and represent that:
a. You are at least the legal age of majority in your jurisdiction and have the full legal capacity and authority to enter into a binding contract;
b. You have read, understood, and agree to be fully and unconditionally bound by this Agreement and all incorporated policies and notices.
4. USER ELIGIBILITY & RESPONSIBILITY
4.1 You represent that you are at least 18 years of age or legally competent under applicable law to enter into this Agreement.

5. ACCOUNT REGISTRATION & ACCESS
5.1 You must create an account to access key features of Peptrait. We reserve the right to suspend or terminate accounts that violate these Terms.
5.2 Peptle may refuse or remove access to any User who misuses the Platform or compromises its integrity.
5.3 You agree that any data or materials submitted by you may be processed, analyzed, and published as part of our verification or scoring system.
6. VERIFICATION SERVICES
6.1 Peptrait offers identity, credibility, and operational verification services based on structured disclosures, documents, algorithms, manual reviews, and third-party assessments.
6.2 Verification outcomes (such as scores, badges, or statuses) are based on inputs, models, and evaluations but do not constitute warranties, guarantees, or legal endorsements.
6.3 Users must not misrepresent verification levels or misuse trust markers.
6.4 All verifications are subject to ongoing review and may be revised, withdrawn, or upgraded at Peptle’s discretion.
6.5 The use of Peptrait verification does not absolve Users of any compliance or legal obligations under other authorities.
6.6 Peptrait is a facilitator of verification—not a regulatory body, credit rating agency, or legal certifier.
7. INTELLECTUAL PROPERTY
7.1 All content, technology, branding, designs, algorithms, and systems on the Platform are the property of Peptle Private Limited or its licensors.
7.2 You may not copy, reverse-engineer, scrape, modify, or exploit the Platform’s intellectual property without prior written consent.
7.3 You retain ownership of content you submit, but grant Peptle a non-exclusive, royalty-free, worldwide license to use, display, reproduce, market, and publish such content for the purposes of verification, profiling, and service delivery.
8. PRIVACY & DATA PROTECTION
8.1 By using the Platform, you consent to the collection, storage, processing, and disclosure of data as described in our Privacy Policy (https://peptrait.com/privacy-policy).
8.2 You may request deletion or anonymization of data in accordance with legal requirements and policy provisions.
9. LIMITATION OF LIABILITY
9.1 To the maximum extent permitted by law, Peptle shall not be liable for:

10. INDEMNIFICATION
You agree to release, indemnify, defend, and hold harmless Peptle Private Limited, including its affiliates, officers, directors, employees, contractors, shareholders, agents, licensors, and assigns (collectively, “Peptle Parties”), from and against any and all claims, demands, actions, causes of action, liabilities, losses, damages, judgments, penalties, fines, costs, and expenses (including reasonable attorneys' fees and legal expenses) arising out of or relating to:
If Peptle is subject to a third-party claim, demand, or legal proceeding as a result of your actions or omissions, Peptle may require you to provide written assurances of your indemnification obligations. Failure to provide such assurances upon reasonable request may be deemed a material breach of this Agreement.
Peptle reserves the right to assume exclusive control over the defense of any matter subject to indemnification by you, at its sole discretion and at its own cost. In such cases, you agree to cooperate fully with Peptle. You shall not settle any matter without the prior written consent of Peptle. Notwithstanding the foregoing, you shall remain solely liable for the full cost of defense and settlement unless otherwise agreed in writing.
11. TERMINATION
11.1 Peptle may suspend or terminate your account and access to the Platform for violation of this Agreement or any policy.
11.2 You may terminate your account at any time by following the Platform’s account closure procedures.
11.3 Upon termination, your access will cease, but Peptle may retain anonymized or archival data as per regulatory or business requirements.
12. GOVERNING LAW, DISPUTE RESOLUTION & ARBITRATION
12.1 Amicable Resolution
The parties shall make all reasonable efforts to resolve any dispute, controversy, or claim arising out of or in connection with this Agreement through good-faith negotiations and mutual discussions.
12.2 Arbitration
If the dispute cannot be resolved amicably within thirty (30) days, it shall be finally resolved through binding arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996 (as amended), and where applicable, in accordance with internationally recognized arbitration standards and procedures. 12.3 Binding Effect of Interim Decisions
Pending final resolution, all operational decisions of Peptle Private Limited related to platform functioning, content moderation, verification status, or account controls shall remain binding and enforceable unless held unlawful by a competent authority.
12.4 Governing Law
This Agreement shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles. To the extent applicable, international treaties and conventions on digital rights, online contracts, and electronic signatures may also be referenced for interpretative purposes.
12.5 Jurisdiction
Subject to the above arbitration clause, the courts of Bangalore, Karnataka, India, shall have exclusive jurisdiction over all disputes arising under this Agreement, including enforcement of arbitral awards.
13. MODIFICATIONS
13.1 Peptle may modify this Agreement at any time. Significant changes will be notified through the Platform.
13.2 Continued use after such updates constitutes acceptance of the revised terms.
14. MISCELLANEOUS
14.1 If any provision of this Agreement is held to be unenforceable, the remainder shall remain in full force and effect.
14.2 Failure to enforce any part of the Agreement shall not constitute a waiver.
14.3 This Agreement constitutes the entire agreement between you and Peptle with respect to Peptrait.
14.4 In the event of any breach of this Agreement or any part of the Peptle Master Policy System (https://policies.peptle.com), including but not limited to willful misconduct, submission of false or misleading information, misuse of the Peptrait Platform, services, or brand, or actions causing reputational damage to Peptle, its affiliates, or its verification ecosystem, the user agrees to unconditionally compensate Peptle Pvt. Ltd. with a lump sum amount. This amount shall be determined solely by Peptle Pvt. Ltd. based on the nature and impact of the breach or misconduct. The user hereby waives any right to contest such valuation and agrees to pay the specified compensation upon demand. This provision is intended to preserve the trust, integrity, and lawful operation of the Peptrait Platform and the Peptle ecosystem. The compensation represents a reasonable estimation of the tangible and intangible harm that may be incurred by Peptle due to such breach or misconduct, and is not intended to operate as a penalty.
15. DISCLAIMER OF WARRANTIES
Your use of this Platform and any services or products offered by Peptle are at your sole risk. The Platform and its services are provided on an “as is” and “as available” basis.
Peptle expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Peptle makes no warranty that:
No advice or information, whether oral or written, obtained by you from Peptle shall create any warranty not expressly stated herein.
Some jurisdictions do not allow the exclusion of implied warranties or limitations on applicable statutory rights, so the above exclusions may not apply to you in full.
